As you probably know by now, the U.S. Supreme Court recently overruled Roe v. Wade, the landmark 1973 ruling that made abortion legal across the U.S. As of June 24, 2022, abortion is no longer protected at the federal level, and individual states will now decide whether to allow abortion within their boundaries. 

We understand that surrogates and intended parents are concerned about this ruling and what it means for their current and future journeys. However, we want to assure you that this decision will NOT impact your journey with Surrogate Parenting Services (SPS). You can learn more below. 

California remains a surrogacy-friendly state 

First, a little background on surrogacy laws in the U.S. There are currently no federal laws in the U.S. regulating surrogacy, and surrogacy laws vary state by state. “Surrogacy-friendly” states either have statutes recognizing and permitting surrogacy, or they have had many favorable rulings in surrogacy cases. 

SPS is based in Orange County, California, and California is considered one of the friendliest states for surrogacy. The California Family Code § 7960 governs gestational surrogacy in the state, which makes the process clear and simple for surrogates and intended parents. 

Here at SPS, we only work with surrogates who are California residents, ensuring the most legal protection for both parties. 

Reproductive health care is protected in California 

Despite the overturning of Roe v. Wade, abortion is still legal in California, and will be for the foreseeable future. The right to abortion is guaranteed in statute and the California state constitution. 

Assisted reproduction technologies such as IVF also remain legal in California. And because we only work with surrogates who are residents of California, your surrogacy journey with SPS will not be affected by the Dobbs ruling.
